WHO REGULATES US

We are directly authorised and regulated by the Financial Conduct Authority (FCA). Our Financial Services Register number is 939746.

Our permitted business is: advising on and arranging non-investment insurance contracts and mortgages.

MORTGAGES

We offer products in the following ‘relevant markets’:

Regulated mortgage contracts that are used for a non-business purpose; and
Regulated mortgage contracts that are used for a business purpose.

We are not limited in the range of mortgages we will consider for you and can offer you advice on both first and second charge mortgages, but not deals that you can only obtain by going direct to a lender.

Please note that, where you are increasing your mortgage borrowing although we do not (or are unable to) advise on the following finance options these may be available to you and be more appropriate:

An unsecured loan

We do not offer products that you can only obtain by going directly to the lender and not via an intermediary.

We offer an ‘advised’ sales service. This means we will provide advice and make a recommendation for you after we have assessed your specific needs and circumstances.

For details of how each of the lenders will collect, use and store your personal information, please refer to their individual privacy policies, which are available on their websites.

PROTECTION

Straker Financial Services Ltd is acting in a purely intermediary capacity. We offer Life, Critical/Serious Illness, Income Protection, Accident/Sickness & Unemployment and Buildings & Contents products. We will make a personal recommendation after we have assessed your needs and circumstances. Your decision to buy or not buy will not affect your application for any non-insurance services such as a mortgage application.

It is essential that you take care to answer any questions on an insurance application form honestly and fully. If you miss any information out, or give us misleading information, this may mean that a future claim will not be paid. In addition, this could also delay the processing of your application.

By proceeding with an application, you understand the provider will use information about you, including health information, to determine whether they can provide you with a policy, and if so, on what terms. You also confirm that you and any other person (e.g. a family member or other individual covered by the policy) understand and have no concerns about their information being used in this way. You can ask the provider to stop using your personal information at any time; however, this may prevent them assessing any future claims and any policies may be cancelled.

BUILDINGS AND CONTENTS POLICIES

We offer products based on a fair and personal analysis for Buildings & Contents Insurance. We will make a personal recommendation after we have assessed your needs and circumstances.

Your decision to buy or not buy will not affect your application with Straker Financial Services Ltd for any non-insurance services such as a mortgage application.

Referring your details to a third party: this will only be done with your permission, and will not affect your rights under our data protection policy. We will specify the names of the individual third parties at the relevant time.

WHAT WILL YOU HAVE TO PAY FOR OUR SERVICES?

Mortgages Advisor Fee

A non-refundable fee of £595 will become payable for each mortgage or secured loan application, split into two payments:

£297.50 payable upon application.
£297.50 payable upon receipt of a mortgage offer from the lender.

We will also be paid commission from the lender.

Please note: We reserve the right to change our administration fee process and descriptions without notice.

An additional fee can be charged for any non-standard mortgage applications. We will tell you how much the total fee will be in good time before you apply for a mortgage, but you may ask for this information earlier.

You will receive a key facts illustration / ESIS when considering a particular mortgage, which will tell you about any fees relating to that mortgage.

You also have the right to request an illustration / ESIS for any mortgage we offer.

Please note our fee will still be charged should the lender reject your application due to you not disclosing any material information about your personal situation. It should also be noted we do not provide a refund should you decide not to proceed with the loan after we have made a recommendation to you.

Insurance

We will arrange the policy with the insurer on your behalf. You do not pay us a fee for doing this. We receive commission from the insurer, which is a percentage of the premium you pay to the insurer. You will receive a quotation that will tell you about any other fees relating to a particular insurance contract.

If we charge you a fee and this is paid, and your mortgage does not go ahead, you will receive no refund. However, if you make a new application within six months of your initial payment, you will not be charged a further administration fee.

PAYMENT OF FEES

This agreement is made between:

It is agreed that:

The Client engages the Arranger to act on his behalf in order to facilitate secured credit or loan facilities (“the Loan”) with a relevant lender (“the Lender”) in connection with the acquisition or remortgage of commercial or residential freehold or leasehold property.

The fee payable by the Client for the Arranger’s services shall be £595 (“the fee”), which will be paid in two installments:

£297.50 payable upon application.
£297.50 payable upon receipt of a mortgage offer from the lender.

All payments to be made by the Client under this agreement shall be made in full without any set-off or withholding for any counterclaim unless the Client is required to do so by law.

If any sum payable under this agreement is not paid when due, then that sum will bear interest from the due date until payment is made in full, both before and after any judgment, at 2% per annum over HSBC Bank plc base rate from time to time.

This is our standard client agreement upon which we intend to rely. For your own benefit and protection, you should read these terms carefully before signing them. If you do not understand any point, please ask for further information.

This agreement shall be governed by and construed in accordance with English Law.

This agreement does not affect any statutory or other right to cancel any life assurance, protection assurance, or pension policy that may have been arranged in connection with the loan.

CONFLICTS OF INTEREST

Occasions may arise where the firm, an employee, or other associates of the firm has competing professional or personal interests which may prevent these services being provided to clients in an independent or impartial manner.

We will take all appropriate steps to prevent conflicts of interests from occurring in line with the firm’s conflicts of interest policy. However, there may be occasions where a conflict of interest cannot be prevented. Where this is the case, we will disclose to you the nature of the conflict and the steps that we will take to mitigate the risks that you will be treated unfairly as a result of any conflicts identified. We will make you aware of any conflicts of interest before the provision of services to enable you to choose whether you still wish to proceed with services. A copy of the firms’ conflict of interest policy is available on request.

We may on occasion receive minor non-monetary benefits from third parties such as product providers e.g. food and drink provided at a provider training event. Where relevant, any minor non monetary benefits received will not conflict with our duty to act in your best interests.

WHAT TO DO IF YOU HAVE A COMPLAINT

If you cannot settle your complaint with us, you may be entitled to refer it to the Financial Ombudsman Service.

ARE WE COVERED BY THE FINANCIAL SERVICES COMPENSATION SCHEME (FSCS)?

We are covered by the FSCS. You may be entitled to compensation from the scheme if we cannot meet our obligations. This will depend on the type of business and the circumstances of the claim.

Mortgage

Mortgage advising and arranging is covered up to a maximum limit of £85,000.

Long term insurance benefits (e.g. Life Assurance)

The maximum level of compensation for claims against firms declared in default is 100% of the claim with no upper limit.

General Insurance

General insurance advice and arranging is covered for 90% of the claim with no upper limit.

Protection is at 100% where claims arise in respect of compulsory insurance (e.g. employer’s liability insurance), professional indemnity insurance and certain claims for injury, sickness or infirmity of the policyholder.

Protection is at 90% where claims arise under other types of policy with no upper limit.

YOUR PERSONAL DATA AND HOW WE USE YOUR INFORMATION

To enable us to manage your authorisation, we will need to hold some personal information about you. The Data Controller in relation to any personal data you supply is Straker Financial Services Ltd and any information you give will be processed in accordance with the Data Protection Act.

WHY WE NEED YOUR DATA

We need to know basic personal data and may share this information:

To enable Straker Financial Services Ltd and our representatives to manage your dealings with us. We may use personal information supplied to manage your appointment with us. Data will be processed in the legitimate interest of the business.
To disclose information to any third parties; such as banks, lenders, insurers, lending specialists, accountants, HMRC or contracted software providers. We may also provide information about you to a future employer, regulator or network in the form of a professional reference. Data will be processed in the legitimate interest of the business.
In order to verify your circumstances, information from third parties may be obtained, such as a previous employment reference, credit check, criminal records check and open source data, to establish experience, suitability, fit and properness. Data will be processed in the legitimate interest of the business.
For compliance monitoring purposes, your data may be made available to the Financial Conduct Authority, or fraud prevention agencies. Data will be processed in the legitimate interest of the business.
To allow Straker Financial Services Ltd or their representatives to conduct compliance monitoring, to prevent financial crime. Data will be processed in the legitimate interest of the business.
To assert our legitimate interest to recover any loss incurred as a result of breaching your terms of your contract with us.

MONEY LAUNDERING

In order to comply with Money Laundering Regulations 2017, we will ask you for documents to confirm your identity and address and, in the case of a purchase, will request evidence of funding and the source of any funds being used. We may also use some of your personal data to carry out electronic identity verification.

The data collected will be processed for the purposes of preventing money laundering and terrorist financing and will not be used for any other purpose without your express permission.

If you are using the services provided by one of our business partners (e.g. mortgage lenders, insurance provider, conveyancer) we may pass your details to them for the purposes of preventing money laundering and terrorist financing.

Under current Data Protection legislation 'relevant authorities' such as the police, government departments and local authorities with regulatory powers are able to request access to personal data without the consent of the data subject for the purposes of the prevention or detection of crime. If you do not provide this information, then we will be unable to consider your authorisation. We will not collect any personal data from you that we do not need in order to provide and oversee our relationship.

If you provide an email address, you consent to us sending communications by email. While we will take reasonable steps to ensure security of information by email, you accept the risks involved with this type of communication.

WHAT WE DO WITH THE DATA

All the personal data we hold about you will be processed by our staff in the United Kingdom, and selected third parties as detailed above will have access to your personal data, where there is a service they provide to us, or there is a legal obligation for us to provide them with this. Please be aware that your information may be stored on a cloud-based system whose servers are located within the United Kingdom.

HOW LONG WILL WE KEEP DATA?

We will generally keep your personal data for a minimum of 7 years after our business relationship, after which time it will be destroyed if it is no longer required for the lawful purpose(s) for which it was obtained. However, if you are working in a certified or senior manager role, we may keep your information longer as a legitimate business interest.

SENSITIVE PERSONAL DATA

In addition to the basic data described above, it may also benefit you to notify us of any health condition or disability you have, provide us with details relating to your financial circumstances and information relating to any criminal convictions so that we are aware of these conditions. This type of information is known as ‘special category information’ (you may also know this as ‘sensitive personal data’) and we require your explicit consent to process this information.

This kind of information will only be collected from you and used by us to assist you in connection with your authorisation to monitor your circumstances, ongoing suitability, fit and properness.

WHAT ARE YOUR RIGHTS?

Under data protection legislation, you have several rights relating to the use of your personal data:

You have the right to ask for a copy of information, usually free of charge. We will respond to this request within a month.
You also have the right for certain data you have provided to us to be provided to you in a structured and commonly used electronic format (for example, a Microsoft Excel file), so that you can move, copy or transfer this data easily to another data controller. You may also request that we transmit this data directly to another organisation where it is practical for us to do so.
You have the right to have personal data rectified if it is inaccurate or incomplete.

This document sets out how we will deal with you in the provision of services for commercial lending. Straker Financial Services is authorised and regulated by the Financial Conduct Authority (FCA) for making introductions to credit lenders. We will ensure when dealing with you, we act in your best interests and apply the regulatory standards for the introduction of this type of business by our Regulator (FCA).

When acting in your best interests, we will source loans from the market that are suitable to the requirements you disclose to us. When the preferred option has been agreed, we will provide you with information about the loan and the provider to ensure you understand your responsibilities and commitments before proceeding. This will include disclosure of the key contract terms, the risks, and all charges payable by you. We will not proceed until you have read and understood all the contractual documents.

Our aim is to provide you with a professional and confidential service that delivers the highest possible standards. However, there may be occasions where you feel this has not been achieved. OUR CHARGES

We will charge you a fee for the service we provide to you:

Application Fee: A non-refundable fee of £295, payable at the application stage.

Broker Fee: A fee of 0.75% of the loan amount agreed, payable once a formal mortgage offer is produced.

During our discussions, we will confirm with you how the broker fee will be collected, as you have the option to pay this directly or in some cases, the fee can be added to the loan amount.

CONFLICTS OF INTEREST

We aim to avoid conflicts of interest. If one arises that can’t be avoided, we’ll inform you in writing. A copy of our policy is available on request.

We may occasionally receive minor non-monetary benefits (e.g., refreshments at training events). These will not affect our obligation to act in your best interest.

Commercial finance is generally unregulated, and the Financial Ombudsman may not be able to help. However, we will handle your complaint fairly and may direct you to other resolution options.

COMPENSATION

BUSINESS BUY TO LET

Regulation & Protection

Any advice and recommendation that may be provided in respect of your business buy to let mortgage requirements is not regulated by the Financial Conduct Authority (FCA).

Your business buy to let mortgage will be deemed as ‘business’ as you are either buying or remortgaging a property which has been acquired with the intention of letting it out.

In addition to business buy to let mortgages, there are other types of arrangements that are not regulated by the FCA. If you are unsure about your own requirements, please ask your adviser for further information.

This will mean you will not receive the protection of the Financial Services Compensation Scheme (FSCS). And may not be entitled to refer any complaints to the Financial Ombudsman Service (FOS) should the need arise.

Disclosure

It is important the information you disclose is accurate. Should you proceed with an application for a business buy to let mortgage the property against which the mortgage will be secured cannot be used as your own residence. If you intend to live in the property at any time, you must disclose this to the lender immediately.

Should you decide to live in a property funded with a business buy to let mortgage, you could be in breach of the conditions of that mortgage. This may result in the lender insisting the loan is repaid. You may also find it more difficult to secure a mortgage in the future.

CONSUMER BUY TO LET

Any advice and recommendation provided in respect of your consumer buy to let mortgage requirement is regulated by the Financial Conduct Authority (FCA).

Your consumer buy to let mortgage will be deemed as ‘consumer’ status due to the property you intend to mortgage being :

A property you initially purchased as your main residence, but now intend to let, or
A residential property that you have inherited and intend to let out.

This will mean that you will not receive the protection of the Financial Services Compensation Scheme (FSCS) but will be entitled to refer any complaints to the Financial Ombudsman Service (FOS) should the need arise.

In addition to consumer buy to let mortgages, there are other types of arrangements that are regulated by the FCA. If you are unsure about your own requirements, please ask your adviser for further information.

OUR LIFETIME MORTGAGES & COSTS

We only advise on lifetime mortgage products but we will consider all lifetime mortgage products across the market that we have access to. We can provide you with a list of the providers we consider on request.

We will only recommend you take out a lifetime mortgage after an assessment of your personal needs and circumstances.

The Cost of Our Services

A non-refundable fee of £995 will become payable for each mortgage or secured loan application, split into two payments:

£497.50 payable upon application.
£497.50 payable upon receipt of a mortgage offer from the lender.

We will also be paid commission from the lender. This amount will be confirmed by the lender in their disclosure document.

Should you wish you can request to view the commission rates from each of the lenders we have considered at the time that we make our recommendation to you.

PAYMENT OF FEES

This agreement is made between:

It is agreed that:

The fee payable by the Client for the Arranger’s services shall be £995 (“the fee”), which will be paid in two installments:

£497.50 payable upon application.
£497.50 payable upon receipt of a mortgage offer from the lender.

All payments to be made by the Client under this agreement shall be made in full without any set-off or withholding for any counterclaim unless the Client is required to do so by law.

This agreement shall be governed by and construed in accordance with English Law.

This agreement does not affect any statutory or other right to cancel any life assurance, protection assurance, or pension policy that may have been arranged in connection with the loan.

CONFLICTS OF INTEREST

We will take all appropriate steps to prevent conflicts of interests from occurring in line with the firm’s conflicts of interest policy. However, there may be occasions where a conflict of interest cannot be prevented. Where this is the case, we will disclose to you the nature of the conflict and the steps that we will take to mitigate the risks that you will be treated unfairly as a result of any conflicts identified. We will make you aware of any conflicts of interest before the provision of services to enable you to choose whether you still wish to proceed with services. A copy of the firm's conflict of interest policy is available on request.

We may on occasion receive minor non-monetary benefits from third parties such as product providers e.g. food and drink provided at a provider training event. Where relevant, any minor non-monetary benefits received will not conflict with our duty to act in your best interests.

WHAT TO DO IF YOU HAVE A COMPLAINT

If you cannot settle your complaint with us, you may be entitled to refer it to the Financial Ombudsman Service.

ARE WE COVERED BY THE FINANCIAL SERVICES COMPENSATION SCHEME (FSCS)

We are covered by the FSCS. You may be entitled to compensation from the scheme if we cannot meet our obligations. This will depend on the type of business and the circumstances of the claim.

Lifetime Mortgages

Lifetime mortgage arranging is covered up to a maximum limit of £85,000.

To enable Straker Financial Services Ltd and our representatives to manage your dealings with us. We may use personal information supplied to manage your appointment with us. Data will be processed in the legitimate interest of the business.

We may also provide information about you to a future employer, regulator or network in the form of a professional reference. Data will be processed in the legitimate interest of the business.
In order to verify your circumstances, information from third parties may be obtained, such as a previous employment reference, credit check, criminal records check and open source data, to establish experience, suitability, fit and properness. Data will be processed in the legitimate interest of the business.
For compliance monitoring purposes, your data may be made available to the Financial Conduct Authority, or fraud prevention agencies. Data will be processed in the legitimate interest of the business.
To allow Straker Financial Services Ltd or their representatives to conduct compliance monitoring, to prevent financial crime. Data will be processed in the legitimate interest of the business.
To assert our legitimate interest to recover any loss incurred as a result of breaching your terms of your contract with us.

MONEY LAUNDERING

The data collected will be processed for the purposes of preventing money laundering and terrorist financing and will not be used for any other purpose without your express permission.

Under current Data Protection legislation, relevant authorities such as the police, government departments and local authorities with regulatory powers are able to request access to personal data without the consent of the data subject for the purposes of the prevention or detection of crime. If you do not provide this information, then we will be unable to consider your authorisation. We will not collect any personal data from you that we do not need in order to provide and oversee our relationship.

FEES – WHAT YOU WILL PAY

Business Loan Advisory Fees

A non-refundable broker fee applies to each finance application. This will be confirmed in writing in your Engagement Letter or Proposal and typically includes:

An initial portion payable at application
The remaining balance on offer or completion

Typical Fee Ranges by Product

Unsecured Loans: 1%–5% of the loan or fixed fee
Commercial Mortgages: 0.5%–2% broker fee (lender fees: 1%–2%)
Bridging Finance: 1%–3% broker fee (plus lender fees)
Development Finance: 1%–2% depending on complexity
Asset/Invoice Finance: 1%–3%, one-off or ongoing

Case-by-Case Fee Assessment

All fees are assessed individually. Your advisor will review your needs and application before confirming final costs. All fees will be disclosed before an application is submitted.

We may also receive commission from lenders. This does not affect the cost of your loan. Commission details will be disclosed.

Please note:

Fees are still payable if your application is rejected due to non-disclosure
No refund is due if you choose not to proceed after a recommendation

PAYMENT TERMS

By signing, you agree for us to arrange finance on your behalf. The fee and schedule will be set out in your Engagement Letter.

All payments must be made in full unless the law requires otherwise. Late payments may incur interest at 2% above HSBC’s base rate.

This agreement is governed by English law.

CONFLICTS OF INTEREST

We aim to avoid conflicts of interest. If one arises that can’t be avoided, we’ll inform you in writing. A copy of our policy is available on request.

We may occasionally receive minor non-monetary benefits (e.g., refreshments at training events). These will not affect our obligation to act in your best interest.

Commercial finance is generally unregulated, and the Financial Ombudsman may not be able to help. However, we will handle your complaint fairly and may direct you to other resolution options.

COMPENSATION

We are covered by the FSCS for regulated activities only. Commercial finance is generally not protected under the FSCS.
